Terms of Use
01 Interpretation & Definitions
Words with capitalised initial letters have meanings defined below and apply equally in singular and plural form.
- Affiliate — an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of shares or equity interest.
- Country — India.
- Company ("we", "us", "our") — CheerStack Technologies Private Ltd, WeWork Olympia Cyberspace, Chennai, India.
- Device — any device that can access the Service, such as a computer, phone, or tablet.
- Service — the BeyondDesk website at www.beyonddesk.com.
- Terms — these Terms of Use, forming the entire agreement between You and the Company regarding use of the Service.
- Third-Party Social Media Service — any content, data, or services provided by a third party that may be displayed or made available through the Service.
- Website — BeyondDesk, accessible from www.beyonddesk.com.
- You — the individual or legal entity accessing or using the Service.
02 Acknowledgement
These Terms govern the use of the Service and form the agreement between You and the Company. They apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you confirm that:
- You have read, understood, and agree to be bound by these Terms.
- You are at least 18 years of age. The Company does not permit those under 18 to use the Service.

04 Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so, including ownership provisions, warranty disclaimers, and limitations of liability.
05 Limitation of Liability
To the maximum extent permitted by applicable law, the entire liability of the Company and its suppliers under these Terms shall be limited to the amount actually paid by you through the Service in the twelve months preceding the claim, or ₹10,000 (Indian Rupees ten thousand) if you have not made any payment.
To the maximum extent permitted by law, in no event shall the Company be liable for any special, incidental, indirect, or consequential damages including but not limited to:
- Loss of profits or revenue
- Loss of data or information
- Business interruption
- Personal injury or loss of privacy
- Failure of third-party software or hardware used with the Service
This applies even if the Company has been advised of the possibility of such damages.
06 "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company expressly disclaims all warranties — express, implied, statutory, or otherwise — including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company provides no warranty that the Service will meet your requirements, be available without interruption, be error-free, or that defects will be corrected. The Company does not warrant the accuracy or reliability of any content provided through the Service, or that the Service is free of viruses or harmful components.
07 Governing Law
These Terms are governed by the laws of India, excluding its conflict of law rules. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
08 Disputes Resolution
If you have a concern or dispute about the Service, you agree to first attempt to resolve it informally by contacting us at [email protected]. We will make reasonable efforts to resolve disputes amicably before either party pursues formal legal proceedings.
09 Severability & Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable. All remaining provisions continue in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right. A waiver of any breach shall not constitute a waiver of any subsequent breach.
10 Translation
These Terms may be made available in languages other than English for convenience. In the event of any inconsistency or conflict between versions, the original English text shall prevail.
11 Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a change is material, we will make reasonable efforts to provide at least 30 days' notice before new terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the updated Terms. If you do not agree, please stop using the Service.
